We share a wall with our neighbour (our garden, their old cowshed, now granny flat) and came back to find a balanced flue now inserted in the wall overhanging our garden. Are there any gas regs or building regs that prevent a flue overhanging a neighbours property. Also what type of fumes are actually given out by a balanced flue, should I even be worried?

Would be grateful if anyone has any thoughts, before I start antagonising my neighbour - easier to be able to say that it cannot be there due to regs…. despite the fact that they obviously came into our garden to instal it!!

I really wouldn't be concerned about fumes more heat, what height is the terminal? can it be touched?
Did they make you aware they were planning this?
You do realize though this could give you big time grief?

Diamondgas covers it pretty well. Not allowed to do it. You could, if you like, take a hammer and flatten it.

The worrying thing is that a 'proper' engineer should have known better. Makes you wonder if its a diy install.
 
Thanks for taking the time to reply all - will have a look at building regs and yes, right on and over the boundary! Hopefully just raising the subject of Building Regs might prompt a rethink…..

The thing is, if it crosses your boundary and you decide to extend your property you could possible be restricted by their appliance flue outlet!
 
they tresspassed to install an illegal outlet that you can report to building regs now, or else you wont be able to winge in a years time. If there is an issue, plant some ivy infront of it and it will soon stop working. I'd be surprised if it is a balanced flue, more likely a room sealed fanned flue which wont work if the inlet gets leaves and crud blocking it!

have a look at page 49 and 50.
the distance to the boundary is not subject to any height, the boundary effectively has no height limit.

it is also covered in the British standards, BS 5440-1:2008.

But more worrying that the manufacturers instructions will also have been ignored!

Have a talk to the neighbor, they might be equally concerned??
If you have no joy, ask Gas safe to take a look,
they will contact the installer (if they have any contact details!)
and make the install comply with the regulations.
 
my view, they either move it or it gets removed, one way or tuther.

the funny thing is this week ive been on a site which has got brand new houses on, half the flues are over the boundary lines. Nhbc inspector must have had his palms greased.

NHBC, you mean the body funded by the developers they are meant to police.

seen british gas do this last year they fitted a baxi duotec flue into neighbours garden in a rented property I look after - they had to move it in the end after arguing

I don;t understand why there are so many suggestion based on sabotaging the appliance. If it is low level, it may be a wall heater, high level a power flued boiler. Regardless, it is an illegal install. Simply speak to the neighbours, and show them Simons Tech Bulletin - page 2, and see what they say. If this provides no satisfaction then report it to Gas Safe - they WILL react. Either it is non registered engineer install or the RGI got it wrong, and will be required to rectify:Report an illegal gas fitter or phone 0800 408 5500

newly qualified or extremely naive if you think gas safe will do b all! I have never had gas safe attend any id situations I have reported bar one, then they did nothing as I repaired the problem for the owners so gas safe closed the case and the original cowboy is still out there roaming the plains
