Hi Gang,
Possibly an easy answer to this. Before the question a quick bit about myself.
I work full time for a HA as Plumber/Gas Foreman (have done for 19 years) and obviously im Gas Safe Registered with the HA.
I also have my own 'small time' plumbing business (you know, evenings & weekends) but dont have my 'own' gas safe registration.
Basically i want to know if i can 'take on' gas work for Mark Moss Plumbing, but use another sole trader who is gas safe registered to do the work and invoice the work from Mark Moss Plumbing. Or would this be considered as doing gas work by an unregistered business.

As long as the person doing the work is registered and fills in the paperwork required relating to gas works carried out,the company can be curtain fitters,so not a problem,the main contractor does not have to be registered
More of a problem may be the company you work for if they find out about the bussiness

The company know about the business (well my bosses do), to be fair i work for a housing association so im not in competition with them.
 
Its not illegal to do "Foreigners" so long as your employer doesn't mind and you declare it for tax. I suppose really speaking being fair to your customers you should also have PLI and all the usual stuff a self employed person has.

I might also add it seems many employers will dismiss you for doing "Foreigners" regardless whether your doing them legitimate or not.
 
Bernie let's not worry about all that, I've been in business (like I said small time) for 2 years now and it's all above board with taxes being paid and insurance ect...ect.... and work know about it. The question was about the gas work.

I was trying to make the point to others who may want to do the same. Yours seems a unique position to be in and must admit I have never known others in the same position.

As to your position regarding sub contracting work out. I think what you propose is legal okay providing the sub contractor meets all the necessary legal requirements.

Lets be frank, there are probably hundreds of sub contractors and probably hundreds of sub contractors sub contractors. Its quite legal as far as I know.
