broggo

Hi all,
Found out today that a landlord is reporting me to gas safe for capping a boiler off.
The flue airf intake was an inch too short and inside the wall also it was angled downwards.
It was at that much of an angle that it was pulling the elbow off the top of the boiler.
Capped and slapped an ID sticker on it.
Apparently it passed a safety check last year and the Landlord is in favour of the engineer that passed it.
Would he have been more satisfied at the tenant becoming ill or dying than paying for a new Flue and a new safety certificate!?
Words fail me.
Bring on the inspector

It's just another tight landlord mate. You did the right thing. You can sleep safe at night. I wouldn't give it a second thought

Playing Devil's Advocate, from the Landlord's point of view, he has paid a supposed registered technician who signed it off as pased, then another engineer comes along and fails it. It has been passed by one engineer. If it were me, supposedly ignorant of such issues and hence paying registered people to look after it, I would report it, because either one of the other equally registered engineers is wrong, and if one says one thing and the other says something else, I wouldn't know who to believe. I would then get the definitive answer and if it was wrong I would have some ammo to take the issue up with the installer.

Was it spilling fumes broggo? Possibility of fumes entering the cavity/property?

My old school general rule of thumb says "spilling fumes or leaking gas into the premis" ID otherwise AR ... I know there's exceptions but it holds true most of the time :) Did you RIDDOR the installation? Good to have HSE on your side IMHO

Why report me tho? He has the engineers name who signed it off. Also he has the installers name. Why not report them? I did everything by the book.

dont worry ive had three customers contact corgi as it was then regarding work id done one was a scheming pig who just didnt want to pay
one was a women who thought her boiler was going to explode as when i serviced it i found a blocked gas pipe and she had never heard it before
the third when we got there the boiler had been moved from where id fitted it in every case the inspectors were fine

If you have followed the requirements and the installation doesn't meet them, then it's pretty clear cut. Chances are the other guy was in a rush to get home and wasn't as thorough as you were.

Sometimes its best to physically show the person the problem and show them where it says in the regulations that it is wrong. If they see it written down in black and white it will usually convince them.

did you get permission to cap it? if so you have NOTHING to worry about, and as its down to poor workmanship i hope you RIDDOR'd it, forget the opinions on its a waste of time, nothing gets done about it etc (opinions i agree with but neither here nor there) as it is mandatory for you to report it via RIDDOR and the inspector will be looking for your DATED copy (within 14 days of the incident) as long as you have your dated copy it wont be your fault if HSE dont have theirs if this happened more than 14 days ago:smilewinkgrin:

Fumes - Possibly
RIDDOR - unfortunatley not pal

if you ID'd it for flue not being fitted properly and fumes escaping you MUST RIDDOR it within 14 days, you could get a wee slap for not doing RIDDOR (if more than 14 days are you SURE you didnt fill one out and send one copy to HSE, have a look in the van to see if you can find your copy of one dated a week last tuesday!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

I do have it in van. Guess i'll be posting it tomorrow.
Cheers Pal

Chances are if gas safe get involved you won't hear about it till later as they will be jumping on the first guy not you.

I am confidant in what I did, and would welcome an inspection.
Nothing to hide or be worried about.

Always best to err on the side of safety and caution broggo .. I wouldn't worry about Gas Safe ... They'd be impressed I'd hope that you did err on the side of caution. End of the day they are now safe!! :)

Um, you can only report gas RIDDORs online now. For more details, see: [DLMURL="http://www.hse.gov.uk/press/2011/hse-iccqa.htm"]Q&A on changes to incident reporting and Infoline services[/DLMURL]

Shock Horror!!!! Got a call from LL asking if id fit new flue. Said he was sorry for flying off the handle and that he'd taken his anger out on the wrong person. Could I fit him in this week as the tenant is cold.
My reply.......... too busy.
Was tempted to go and charge the earth but not prepared to face anymore hassle from him.

I thought you only RIDDOR when the offending item has been fitted in the past six months?

Maybe someone can correct me

As for this situation you did the right thing.

i have never seen a timeline for reporting RIDDOR, (maybe i need to read the form properly, but dont think there is any time mentioned anywhere)
whether anything is done about a job done a couple of yrs ago is debatable, as people seem to report new crappy jobs and nithing is getting done
