I need some help

We have just had an extension built and a downstairs toilet is to be fitted, there is an upstairs toilet which will be connected via the same waste pipe, our builder says the durgo valve can be installed above the ground floor toilet but I thought it had to be 150mm above the highest water exit point which is the upstairs bath?
 
Check with manufacturers instructions they do vary a bit.
We use polypipe air admittance valves instructions on them state must be above spill over hight of highest appliance connected to soil stack. So on that basis above the top of your bath.
