e4gas here is your photos for you :)

You need to find out what the manufacture allows clearance wise, but that flue is far too long coming out the roof and could do with being properly sealed.

I was thinking the same , fit flue correctly , should give anoth distance , vaillant boiler

Even if you fit the flue correctly to the roof it is still in an unsuitable position below the opening window. Move the boiler to a more suitable position.

I agree, looks like the boiler may have to move

Not a facetious comment (as if I would) but if the flue is correct in every other way, you could always secure the window shut.

there was a post regarding a gas engineer who fitted a boiler and the windows were non openable,a few years on and the windows were changed and open windows fitted,a fatality occured and he was found guilty.move the boiler.

That would be a harsh judgement IMO. Would you be expected to be responsible for fitting a boiler and then sometime later a conservatory was built which enclosed the flue and a fatality occurred?

surely it should be the idiot who built the conservatory who would be held liable. but as we all know people in power have no common sense.

Contact manufacturer to see if they can help also ask custard for any paperwork to see if you can find out who installed it

as i said,it was posted and that is what happened,i agree with the conservatory scenario, how many times have we came across a flue being too close to these?but you need to give some thought into future alterations especially if near to an opening, harsh yes but it happened,so i would advise to relocate the appliance to a safe location.
